'Hot' Guns Fueling Crime, US Study Says

Christmas is the one day of the year that Wal-Mart is closed, but for a group of four New Mexico burglars, it was the perfect time to stop in for some firearms.

Video surveillance cameras caught the masked burglars red-handed, stealing rifle after rifle. Police arrested the four men, and were able to recover the guns. But all too often, stolen weapons end up in the hands of criminals.

The New Mexico caper is part of a flood of gun thefts nationwide. And it's not only commercial gun dealers vulnerable to theft.

Guns are a top target for home burglars looking for something they can easily sell on the street.

An estimated 230,000 guns per year are stolen in home burglaries and property crimes, according to a study by the Department of Justice.

"Any burglar that goes in a house and finds guns, their eyes are going to light up," says former ATF Assistant Director Mike Bouchard. "That's the first thing they're going to take."

The statistics for commercial thefts show that nearly 25,000 guns per year are lost or stolen from gun dealers.

According to the Bureau of Alcohol Tobacco and Firearms (ATF), more than 4,000 gun stores and retailers have been targeted in the last three years, with 74,000 guns reported stolen or lost. And criminals will use any method possible to get their hands on some weapons, either for their own use, or to sell on the black market.

Recently, thieves have taken to using a stolen vehicle to ram down the front doors of a gun store. In North Charleston, S.C., for example, burglars smashed a stolen truck right through Guns and Gold Trading Post, stealing $4,500 worth of guns before making a quick getaway.

"Gun stores are like candy stores for criminals," says Mike Bouchard.

2012 was a record year for gun sales, with more than 19.5 million background checks run for gun purchases, up almost 20% from the previous year. But while legitimate sales skyrocket, huge numbers of illegal guns are hitting the streets.

According to the Justice Department, more than 1.4 million guns were stolen or lost between 2005 and 2010.

Former ATF Assistant Director Bouchard says crooks have easy access to cheap stolen guns on the street.

"If you talk to any criminal, they can find a gun within an hour or two. Cheaper guns that were stolen can be sold for $50. On the street, a typical good handgun will run you $200 to $300," Bouchard said.

Some thieves have even targeted gun shipments, stealing the weapons before they get to market.

Last November, for example, a rogue truck driver allegedly stole a shipment of 111 guns he was supposed to deliver from the Smith and Wesson factory in Springfield, Mass.

When police caught him, they recovered 28 of the stolen guns, but some had already been used in crimes.

When police arrested the alleged stick-up robber known as the Black Jacket Bandit, they found one of the stolen guns was allegedly used by him in a convenience store robbery within weeks of the delivery heist.

In November, more than 100 powerful AK-47s were stolen from a rail yard in Atlanta. The guns were in a box car containing more than 1,000 guns being shipped from an overseas manufacturer to a major U.S. distributor, authorities say.

A few of the weapons have been recovered, but police are deeply concerned about having scores of new assault rifles falling into the wrong hands.

Given all the gun thefts, police say it is critical for gun owners to secure their weapons in gun safes or locked cases. And authorities are urging gun retailers to fortify their buildings, to try to prevent "smash and grab" type robberies.

Will Women Register for Selective Service?

Defense Secretary Leon Panetta today lifted the ban on women serving in combat positions, opening the door to more than 200,000  new military posts and raising a number of important questions, including: Will women eventually be eligible for the draft?

By law, all male U.S. citizens and permanent residents must register with the Selective Service System within 30 days of their 18th birthday. Registration puts those “male persons” on the list the government uses if ever the draft returns and conscription in the military is deemed necessary in a time of war.

As of a 1994 review, women were still exempt from registering because they did not serve in combat positions. Today’s change in Pentagon policy, however, could ultimately result in a change to the law.

But it will take more than just the stroke of the defense secretary’s pen for the Selective Service Act to include mention of women.

With any change to personnel policies, the Defense Department  is “required to provide an analysis of its impact on the Selective Service Act,” said a senior Pentagon official said on the condition of anonymity.  “So that will be part of the notification to Congress.”

But what comes next is  unclear.

“With regard to what will happen from there, I can’t say,” said the official.

Defense Secretary Leon Panetta later admitted to reporters that he, too, did not know the potential impact of the change to the Selective Service Act.

“That’s not our operation,” said Panetta.

Known for his use of colorful language, Panetta then said, “I don’t know who the hell controls Selective Service, if you want to know the truth.”

“But, you know,” Panetta added. “Whoever does, they’re going to have to exercise some judgment based on what we just did.”

The Selective Service System is a federal agency independent of the Department of Defense.

Clinton on Benghazi: Afghanistan Diverted Resources

House Republicans slammed Secretary of State Hillary Clinton today for her lack of awareness of State Department cables warning of security threats in Benghazi, Libya, prior to the Sept. 11 attack that killed four Americans, including Amb. Chris Stevens.

In the second congressional hearing of the day reviewing a report by the Accountability Review Board on the State Department's security failures, Rep. Michael McCaul, R-Texas, asked Clinton this afternoon why her office had not responded to a notification from Stevens about potential dangers in Libya.

"Congressman, that cable did not come to my attention," Clinton calmly told the House Foreign Affairs Committee hours after her Senate testimony this morning. "I'm not aware of anyone within my office, within the secretary's office having seen that cable."

She added that "1.43 million cables come to my office. They're all addressed to me."

Rep. Matt Salmon, R-Ariz., asked Clinton whether she thought that signaled the need for a shifting of priorities to make sure she is notified about these kinds of threats in the future.

"That's exactly what I'm intent on doing," Clinton said. "We have work to do. We have work to do inside the department. We have work to do with our partners in DOD and the intelligence community."

Such answers failed to appease members like Rep. Jeff Duncan, R-S.C., who accused Clinton of letting "the consulate become a death trap."

Clinton also told the House committee that an emphasis on security in Iraq and Afghanistan in the past decade diverted resources from other outposts around the world.

She told Rep. Chris Smith, R-N.J., that legislation he championed reorganizing the State Department in the 19990s had "been very important in protecting our people around the world," but that the need for funding was ongoing and unmet.

Clinton reprised her role as defender of the State Department this afternoon in the second half of congressional testimony on the security failures that led to the deaths of Stevens and the other Americans.

Stevens understood the significance of the mission, she told the committee several hours after a morning Senate appearance.

"That's why Chris Stevens went to Benghazi in the first place," she said. "Nobody knew the dangers better than Chris, first during the revolution and then during the transition. A weak Libyan government, marauding militias, even terrorist groups … a bomb exploded in the parking lot of his hotel. He never wavered. He never asked to come home. He never said let's shut it down, quit, go somewhere else."

Representatives repeatedly asked about U.N. Ambassador Susan Rice's assertion on Sunday morning talk shows in September that the attack was fueled by outrage over a video attacking Islam.

Clinton's response was to refer to the ARB report, which said the motivations behind the attack were complicated and still not all known. She maintained that Rice was speaking based upon talking points given to her by the intelligence community.

Rep. Joe Wilson, R-S.C., asked why the secretary of state herself did not appear in Rice's place to give those televised explanations to the country.

"Well, I have to confess here in public [that] going on the Sunday shows is not my favorite thing to do. There are other things that I prefer to do on Sunday mornings," Clinton replied. "And I did feel strongly that we had a lot that we had to manage, that I had to respond to. And I thought that should be my priority."

The afternoon appearance followed morning testimony from an energized Clinton, who stood her ground and told the Senate Foreign Relations Committee that she has overseen plans to secure diplomatic outposts around the world while cuts in State Department funding undermine those efforts.

Citing a report by the department's Accountability Review Board on the security failures that led to the deaths of four Americans in Benghazi, Libya, during an attack last year, Clinton said the board is pushing for an increase in funding to facilities of more than $2 billion per year.

"Consistent shortfalls have required the department to prioritize available funding out of security accounts," Clinton told the Senate this morning, while again taking responsibility for the Benghazi attack. "And I will be the first to say that the prioritization process was at times imperfect, but as the ARB said, the funds provided were inadequate. So we need to work together to overcome that."

Clinton, showing little effect from her recent illnesses, choked up earlier in discussing the Benghazi attack.

"I stood next to President Obama as the Marines carried those flag-draped caskets off the plane at Andrews," Clinton said this morning, her voice growing hoarse with emotion. "I put my arms around the mothers and fathers, sisters and brothers, sons and daughters."

The outgoing secretary of state was the only witness to giving long-awaited testimony before the Foreign Relations Committee this morning, and appeared before the House Foreign Affairs Committee at 2 p.m.

The secretary, who postponed her testimony in December, started today by giving context to the terrorist attack.

"Any clear-eyed examination of this matter must begin with this sobering fact," Clinton began. "Since 1988, there have been 19 Accountability Review Boards investigating attacks on American diplomats and their facilities."

But the secretary did not deny her role in the failures, saying that as secretary of state, she has "no higher priority and no greater responsibility" than protecting American diplomats abroad like those killed in Benghazi.

"As I have said many times, I take responsibility, and nobody is more committed to getting this right," Clinton said. "I am determined to leave the State Department and our country safer, stronger and more secure."

Among the steps Clinton has taken, she said, is to "elevate the discussion and the decision-making to make sure there's not any" suggestions that get missed, as there were in this case.

Clinton testified that the United States needs to be able to "chew gum and walk at the same time," working to shore up its fiscal situation while also strengthening security, and she refuted the idea that across-the-board cuts slated to take place in March, commonly referred to as sequestration, were the way to do that.

"Now sequestration will be very damaging to the State Department and USAID if it does come to pass, because it throws the baby out with the bath," Clinton said, referring to the United States Agency for International Development, which administers civilian foreign aid.

While the State Department does need to make cuts in certain areas, "there are also a lot of very essential programs … that we can't afford to cut more of," she added.

More than four months have passed since the attack killed U.S. Ambassador Christopher Stevens and three other Americans in Libya. These meetings, during which Clinton discussed the report on State Department security failures by the Accountability Review Board, were postponed because of her recent illness.

Clinton told the Senate that the State Department is on track to have 85 percent of action items based on the recommendations in the ARB report accomplished by March, with some already implemented.

Teen Planned to Attack Walmart After Killing Family

The New Mexico teenager who used an assault rifle to kill his mother, father and younger siblings told police he hoped to shoot up a Walmart after the family rampage and cause "mass destruction."

Police said they are also considering charging the shooter's 12-year-old girlfriend.

According to new information released by police today, Nehemiah Griego, the 15-year-old son of an Albuquerque pastor, had plans to kill his family, his girlfriend's family, and local Walmart shoppers for weeks before he acted on the impulse on Sunday.

"Nehemiah said after killing five of his family members he reloaded the weapons so that he could drive to a populated area to murder more people," a police report from the incident stated.

"Nehemiah stated he wanted to shoot people at random and eventually be killed while exchanging gunfire with law enforcement," the report said.

The shooting spree began shortly around 1 a.m. on Sunday, when Griego snuck into his parents' bedroom while his mother, Sara Griego, was asleep. There he raided the closet where the family kept their guns, and immediately used a .22 rifle to kill her, according to the Bernalillo County Sheriff's Department.

Griego's 9-year-old brother was sleeping with his mother at the time and woke up. When Griego told the boy his mother was dead, the youngster didn't believe him, according to a police report.

"So Nehemiah picked up his mother's head to show his brother her bloody face," the report states. "Nehemiah stated his brother became so upset so he shot his brother in the head."

He then went into his sisters' bedroom. "Nehemiah stated when he entered he noticed that his sisters were crying and he shot them in the head," the police report states. The girls were 5 and 2 years old.

The teenager waited for his father to come from his overnight shift working at a nearby rescue mission. When his father, Greg Griego, walked into the home around 5 a.m., unaware of what had taken place, Griego shot him multiple times with the AR-15 rifle, Sheriff Dan Houston said today.

Greg Griego was a former church pastor at Calvary Church in Albuquerque, and worked as a chaplain at a local jail where he counseled convicts. The family was very involved in the church, according to its website.

The complaint said Griego took a photo of his dead mother and "sent it to his girlfriend."

Griego then packed up the guns, including two shotguns, as well as ammunition for the rifles, and planned to drive to a Walmart to shoot additional people.

Houston said today that Griego called his 12-year-old girlfriend Sunday and ended up spending the entire day with her rather than going to the Walmart. Around 8 p.m. on Sunday, the pair drove to Calvary Church, and Griego said his family had died in a car crash. Someone on the church's staff then called 911, Houston said.

"At this time, Nehemiah had been contemplating this for some time. The information that Nehemiah had contemplated going to the local Walmart and participating in a shooting in there is accurate," Houston said. "There is no information at all that he went to church to cause anyone bodily harm there. The suspect also contemplated killing his girlfriend's parents."

The girlfriend's name was not released, but police are investigating whether to press any charges against her, Houston said. Houston said she had some knowledge about the deaths during the day Sunday.

Griego told cops he sent a picture of his dead mother to his girlfriend after the murder.

Sheriff's deputies were dispatched to the Griego home around 9:15 p.m. on Sunday and arrived 10 minutes later, where they found the five bodies.

Griego lied to investigators about the attack, telling them he came home around 5 a.m. that morning and found his family dead. He said he then took the guns to protect himself.

Griego quickly admitted to the crime when pressed by police, telling investigators he was "frustrated" with his mother. Deputies said he was "unemotional" and "very stern" during the confession.

Obama's 2nd Term: Whose Time Is 'Our Time'?

President Obama used a brief pause in the partisan warfare that’s scarred his time in office to return to the ideals of the Declaration of Independence, with his own declaration of urgency and a call to action that reflects shared sacrifice and responsibility.

This was no centrist conciliator. It was the speech of a committed, unapologetic progressive, an Obama doctrine for domestic policy that included concrete commitments in areas he made little progress on over his first four years. Above all, he was speaking to a changing America – the nation that propelled him to a second term, and whose voices he will need to channel to be effective over the next four years.

“My fellow Americans, we are made for this moment, and we will seize it – so long as we seize it together,” the president declared.

That word “together” appeared seven times in the president’s speech. He used the phrase, “we, the people” five times. Notably, the president said “our time” five times. It was a clear signal that Obama is not satisfied with the frustrations that marked his first term, and that he is cognizant of his opportunity at this moment.

And he sees those opportunities mainly to his left. Obama made a firm commitment to pursue climate-change legislation, in addition to immigration reform and gun control. In an era of budget-cutting, he delivered a rousing endorsement of the social safety net, including Medicare and Social Security.

Obama cited the civil-rights movement and listed Stonewall – the 1960s demonstrations over a police raid of a New York City gay bar that galvanized the gay-rights movement – alongside Seneca Falls and Selma. He also promised equality for “our gay brothers and sisters,” apparently becoming the first president to use the word “gay” in an inaugural address.

Obama’s defining challenge as president has been to deliver on the hope and promise he rode into office on in 2008. He may never hope to fulfill the expectations that surrounded his elevation. But speaking to the largest crowd he’s likely to ever appear before again, the president sounded both more optimistic and more committed to progress on his priorities than anything in our current political system would suggest is warranted.

“Progress does not compel us to settle centuries-long debates about the role of government for all time, but it does require us to act in our time,” the president said.

For a president whose very inauguration speaks to the promise of America, but whose first term ended with so much frustration, it was a return to his roots. President Obama is cognizant of his role in history, though clearly not content with leaving it at that.

President Barack Obama and Vice President Joe Biden today officially embarked on their second term, taking the Constitutionally mandated oath of office in two separate private ceremonies inside their homes.

Shortly before noon in the Blue Room of the White House, Obama raised his right hand, with his left on a family Bible, reciting the oath administrated by Chief Justice John Roberts. He was surrounded by immediate family members, including first lady Michelle Obama and daughters, Malia and Sasha.

As he hugged his wife and daughters, Sasha said, "Good job, Daddy."

"I did it," he said.

"You didn't mess up," she answered.

Biden was sworn in earlier today by Justice Sonia Sotomayor, the first Hispanic to administer a presidential oath, in a ceremony at his official residence at the U.S. Naval Observatory. He was joined by more than 120 guests, including cabinet members, extended family and his wife, Dr. Jill Biden.

Because Jan. 20 -- the official date for a new presidential term -- falls on a Sunday this year, organizers delayed by one day the traditional public inauguration ceremony and parade down Pennsylvania Avenue.

Obama and Biden will each repeat the oath on Monday on the west front of the Capitol, surrounded by hundreds of dignitaries and members of Congress. An estimated 800,000 people are expected to gather on the National Mall to witness the moment and inaugural parade to follow.

The dual ceremonies in 2013 means Obama will become the second president in U.S. history to take the presidential oath four times. He was sworn in twice in 2008 out of an abundance of caution after Roberts flubbed the oath of office during the public administration. This year Roberts read from a script.

Franklin Roosevelt was also sworn in four times but, unlike Obama, he was elected four times.

This year will mark the seventh time a president has taken the oath on a Sunday and then again on Monday for ceremonial purposes. Reagan last took the oath on a Sunday in 1985.

Both Obama and Biden took the oath using a special family Bible. Obama used a text that belonged to Michelle Obama's grandmother LaVaughn Delores Robinson. Biden placed his hand on a 120-year-old book with a Celtic cross on the cover that has been passed down through Biden clan.

The official inaugural activities today also included moments of prayer and remembrance that marked the solemnity of the day.

Obama and Biden met at Arlington National Cemetery for a brief morning ceremony to place a wreath on the Tomb of the Unknowns, honoring military service members who served and sacrificed. The men stood shoulder to shoulder, bowing their heads as a bugler played "Taps."

Biden, who is Catholic, began the day with a private family mass at his residence. The president and first family attended church services at Metropolitan African Methodist Episcopal Church, a historically black church and site of two pre-inaugural prayer services for former President Bill Clinton and Vice President Al Gore and their families.

The Obamas and Bidens plan to participate in a church service on Monday morning at St. John's Episcopal, across Lafayette Park from the White House. They will also attend a National Prayer Service on Tuesday at the National Cathedral.

Later on Sunday evening, the newly-inaugurated leaders will attend a candlelight reception at the National Building Museum. The president and vice president are expected to deliver brief remarks to their supporters.

Algeria Hostage Crisis Over, One American Dead

After the Algerian military's final assault on terrorists holding hostages at a gas complex, the four-day hostage crisis is over, but apparently with additional loss of life among the foreign hostages.

One American, Fred Buttaccio of Texas, has been confirmed dead by the U.S. State Department. Two more U.S. hostages remain unaccounted for, with growing concern among U.S. officials that they did not survive.

But another American, Mark Cobb of Corpus Christi, Texas is now confirmed as safe. Sources close to his family say Cobb, who is a senior manager of the facility, is safe and reportedly sent a text message " I'm alive."

In a statement, President Obama said, "Today, the thoughts and prayers of the American people are with the families of all those who were killed and injured in the terrorist attack in Algeria. The blame for this tragedy rests with the terrorists who carried it out, and the United States condemns their actions in the strongest possible terms. ... This attack is another reminder of the threat posed by al Qaeda and other violent extremist groups in North Africa."

According to Algerian state media, 32 militants are dead and a total of 23 hostages perished during the four-day siege of the In Amenas facility in the Sahara. The Algerian Interior Ministry also says 107 foreign nationals who worked at the facility for BP and other firms were rescued or escaped from the al Qaeda-linked terrorists who took over the BP joint venture facility on Wednesday.

The Japanese government says it fears "very grave" news, with multiple casualties among the 10 Japanese citizens working at the In Amenas gas plant.

Five British nationals and one U.K. resident are either deceased or unaccounted for in the country, according to British Foreign Minister William Hague. Hague also said that the Algerians have reported that they are still trying to clear boobytraps from the site.

Armstrong May Have Lied to Oprah: Investigators

Lance Armstrong may have lied to Oprah Winfrey during his so-called confession Thursday night about his doping during the Tour de France bicycle race, investigators told ABC News today.

Armstrong, 41, admitted for the first time that his decade-long dominance of cycling and seven wins in the Tour de France were owed, in part, to performance-enhancing drugs and oxygen-boosting blood transfusions. He told Winfrey that he was taking the opportunity to confess to everything he had done wrong, including angrily denying reports for years claiming that he had doped.

Investigators familiar with Armstrong's case, however, said today that Armstrong didn't completely come clean. They say he blatantly lied about when he stopped doping, saying the last time he used the drugs and transfusions was the 2005 race.

"That's the only thing in this whole report that upset me," Armstrong said during the interview. "The accusation and alleged proof that they said I doped [in 2009] is not true. The last time I crossed the line, that line was 2005."

"You did not do a blood transfusion in 2009?" Winfrey asked.

"No, 2009 and 2010 absolutely not," Armstrong said.

Investigators familiar with the case disagree. They said today that Armstrong's blood values at the 2009 race showed clear blood manipulation consistent with two transfusions. Armstrong's red blood cell count suddenly went up at these points, even though the number of baby red blood cells did not.

Investigators said this was proof that he received a transfusion of mature red blood cells.

If Armstrong lied about the 2009 race, it could be to protect himself criminally, investigators said.

Federal authorities looking to prosecute criminal cases will look back at the "last overt act" in which the crime was committed, they explained. If Armstrong doped in 2005 but not 2009, the statute of limitations may have expired on potential criminal activity.

The sources noted that there is no evidence right now that a criminal investigation will be reopened. Armstrong is facing at least three civil suits.

The second half of Armstrong's interview is set to air tonight.

Shock and disenchantment were among the reactions from people most familiar with the famed cyclist's history after his on-air confession Thursday night.

"I could not believe that Lance apologized," Betsy Andreu, the wife of Armstrong's former teammate and close friend Frankie Andreu, said today on ABC's "Good Morning America".

"Lance doesn't say, 'I'm sorry.' Lance isn't used to telling the truth and so I think in the days to come, in the months to come, I'm hoping that we'll see the contrition. Actions speak louder than words so if the words aren't empty ...," Andreu said.

ABC News consultant and USA Today columnist Christine Brennan called Armstrong's admitting that he used performance-enhancing drugs "a major miscalculation."

"This is like Bernie Madoff coming back after three months or Richard Nixon coming back after three months. No one wants to hear from those people so soon," Brennan told George Stephanopoulos on "Good Morning America."

"It was a lose-lose going in. I think he did more harm than good to his reputation, and he just looked cold-blooded, and cutthroat, and ruthless," Brennan said.

Minutes after Armstrong's confession aired on Oprah Winfrey's OWN network, the Livestrong Foundation -- the Austin-Texas-based cancer charity that he founded -- released a statement expressing disappointment in their former leader.

"We at the LIVESTRONG Foundation are disappointed by the news that Lance Armstrong misled people during and after his cycling career, including us," the statement read. "Earlier this week, Lance apologized to our staff and we accepted his apology in order to move on and chart a strong, independent course.

"Our success has never been based on one person -- it's based on the patients and survivors we serve every day, who approach a cancer diagnosis with hope, courage and perseverance."

Travis Tygart, head of the U.S. Anti-Doping Agency, said in a statement, "Tonight, Lance Armstrong finally acknowledged that his cycling career was built on a powerful combination of doping and deceit. His admission that he doped throughout his career is a small step in the right direction. But if he is sincere in his desire to correct his past mistakes, he will testify under oath about the full extent of his doping activities."

The agency issued an October report in which 11 former Armstrong teammates described the system under which they and Armstrong received drugs with, they say, the knowledge of their coaches and help of team physicians. As a result of the organization's findings, Armstrong was stripped of his seven Tour de France titles. Soon, longtime sponsors including Nike began to abandon him, too.

John Fahey, president of the World Anti-Doping Agency said, "He was wrong, he cheated and there was no excuse for what he did. If he was looking for redemption, he didn't succeed in getting that."

Such a reaction\ to the highly anticipated interview was only the tip of the iceberg as pundits, those close to Armstrong and even everyday people took to Twitter and other social media outlets to share their thoughts on what Armstrong said was "one big lie that I repeated a lot of times."

Cyclist and former Armstrong teammate Jonathan Vaughters tweeted, "A good first step. I need to sleep."

Biden Confirms Support for Second Amendment

One day after President Obama unveiled the administration’s plan to curb gun violence, Vice President Joe Biden today defended their intentions, answering critics who have spoken out against the plan for potentially infringing on the Second Amendment rights of Americans.

“The president and I support the Second Amendment,”  Biden said definitively.

Biden, who’s led the task force on gun violence since the December shooting at Sandy Hook Elementary School, noted that he owns guns.

“I have two shotguns, a 20-gauge and a 12-gauge shotgun,” he said. Later in the speech he said his son Beau was a better shot than he is but that is because Beau is in the Army.

Biden spoke today before the annual U.S. Conference of Mayors’ meeting in Washington, D.C. Not everyone in the audience, Biden noted today, agrees with recommendations the White House put forward yesterday. But he defended the administration’s move to push this issue, at one point addressing the roomful of mayors as if he were speaking to them individually, saying that “murder rates in both of our towns are …  well beyond … what’s remotely tolerable for a civilized circumstance.”

“We’re going to take this fight to the halls of Congress,” he said. “We’re going to take it beyond that. We’re going to take it to the American people. We’re going to go around the country making our case, and we’re going to let the voices, the voice, of the American people be heard. ”

Biden again noted that there will not be consensus across the nation, given cultural differences among the states. In many states, he added, hunting is  “big deal.”

But, he quipped, addressing the use of high-capacity magazines in hunting, “As one hunter told me, if you got 12 rounds — you got 12 rounds, it means you’ve already missed the deer 11 times. You should pack the sucker in at that point. You don’t deserve to have a gun, period, if you’re that bad.”

High-capacity ammunition magazines “leave victims with no chance,” Biden said.

He summed up saying, “Recognizing those differences doesn’t in any way negate the rational prospect of being able to come up with common-sense approaches how to deal with the myriad of problems that relate to gun ownership.”

Biden said the “time is now” to make these changes and scoffed at some alternative strategies, like the proposal from the NRA for an armed guard to be placed in every school.

“We don’t want rent-a-cops in schools armed,” he said. “We don’t want people in schools who aren’t trained like police officers.”

FAA Grounds Boeing 787 Dreamliners

The Federal Aviation Administration has ordered the grounding of Boeing 787 Dreamliner jets until their U.S. operator proves that batteries on the planes are safe.

United is the only U.S. carrier flying the Boeing 787s, which have been touted as the planes of the future. However, several operated by overseas airlines have run into recent trouble, the latest because of a feared battery fire on a 787 today in Japan.

The FAA's so-called emergency airworthiness directive is a blow to Boeing, from the same government agency that only days ago at a news conference touted the Dreamliner as "safe." Even Secretary of Transportation Ray LaHood went so far as to say he would have no issue flying on the plane.

Now, United will need to prove to the FAA that there is no battery fire risk on its six Dreamliners. An emergency airworthiness directive is one that requires an operator to fix or address any problem before flying again.

"Before further flight, operators of U.S.-registered Boeing 787 aircraft must demonstrate to the Federal Aviation Administration (FAA) that the batteries are safe and in compliance," the FAA said in a statement today. "The FAA will work with the manufacturer and carriers to develop a corrective action plan to allow the U.S. 787 fleet to resume operations as quickly and safely as possible."

United Airlines responded tonight with a statement: "United will immediately comply with the airworthiness directive and will work closely with the FAA and Boeing on the technical review as we work toward restoring 787 service. We will begin reaccommodating customers on alternate aircraft."

There are some 50 Dreamliners flying in the world, mostly for Japanese airlines, but also for Polish and Chilean carriers.

Overseas operators are not directly affected by the FAA's emergency airworthiness directive -- but Japanese authorities grounded all of their 787s overnight after All Nippon Airways (ANA) said a battery warning light and a burning smell were detected in the cockpit and the cabin, forcing a Dreamliner, on a domestic flight, to land at Takamatsu Airport in Japan.

The plane landed safely about 45 minutes after it took off and all 128 passengers and eight crew members had to evacuate using the emergency chutes. Two people sustained minor injuries on their way down the chute, Osamu Shinobe, ANA senior executive vice president, told a news conference in Tokyo.

ANA and its rival, Japan Airlines (JAL), subsequently grounded their Dreamliner fleets. ANA operates 17 Dreamliner planes, while JAL has seven in service.

Both airlines said the Dreamliner fleet would remain grounded at least through Thursday.

ANA said the battery in question during today's incident was the same lithium-ion type battery that caught fire on board a JAL Dreamliner in Boston last week. Inspectors found liquid leaking from the battery today, and said it was "discolored."

Japan's transport ministry categorized the problem as a "serious incident" that could have led to an accident.

Even more shaken up than the passengers on the Japanese flight may be the reputation of America's largest plane manufacturer, Boeing.

Since the 787 -- with a body mostly made of carbon fiber -- was introduced, it's had one small problem after another. But the nagging battery issue, which caused an onboard fire at Boston's Logan Airport last week, was serious enough for the FAA to ground the plane.

"It's a rough couple weeks for Boeing and ANA," said John Hansman, an MIT professor of aeronautics and astronautics. "I think clearly in the short term this type of bad press has been tough for Boeing. I think in the long haul, this is a good airplane. It's in a good market."

NY Passes Nation's Toughest Gun Law

Today New York became the first state to pass a gun control law -- the toughest in the nation -- since the Sandy Hook Elementary School shooting massacre last month.

Acting one month and a day since the rampage killing that left 20 first-graders and six educators dead, Gov. Andrew Cuomo signed the bill into law shortly after 5 p.m.

Called the New York Safe Act, the law includes a tougher assault weapons ban that broadens the definition of what constitutes an assault weapon, and limits the capacity of magazines to seven bullets, down from 10. The law also requires background checks of ammunition and gun buyers, even in private sales, imposes tougher penalties for illegal gun use, a one-state check on all firearms purchases, and programs to cut gun violence in high-crime neighborhoods.

As he signed the bill into law, Cuomo said it was not only "the first bill" but the "best bill."

"I'm proud to be a New Yorker, because New York is doing something, because we are fighting back, because, yes, we've had tragedies, and yes, we've had too many innocent people lose their lives, and yes, it's unfortunate that it took those tragedies to get us to this point, but let's at least learn from what's happened, let's at least be able to say to people, yes, we went through terrible situations, but we saw, we learned, we responded, and we acted, and we are doing something about it," Cuomo said. "We are not victims.

"You can overpower the extremists with intelligence and with reason and with commonsense," Cuomo continued, "and you can make this state a safer state."

New York's law also aims to keep guns out of the hands of those will mental illness. The law gives judges the power to require those who pose a threat to themselves or others get outpatient care. The law also requires that when a mental health professional determines a gun owner is likely to do harm, the risk must be reported and the gun removed by law enforcement.

The legislation also includes what is called a "Webster provision," named for the two firefighters ambushed on Christmas Eve in Webster, N.Y. The measure would mandate a life sentence with no chance of parole for anyone who kills a first responder.

The National Rifle Association issued a statement after the bill's signing, saying it was "outraged at the draconian gun control bill that was rushed through ... late Monday evening."

"Gov. Andrew Cuomo and the New York State Legislature orchestrated a secretive end-run around the legislative and democratic process and passed sweeping anti-gun measures with no committee hearings and no public input," the statement read. "These gun control schemes have failed in the past and will have no impact on public safety and crime. Sadly, the New York Legislature gave no consideration to that reality. While lawmakers could have taken a step toward strengthening mental health reporting and focusing on criminals, they opted for trampling the rights of law-abiding gun owners in New York, and they did it under a veil of secrecy in the dark of night. The legislature caved to the political demands of a governor and helped fuel his personal political aspirations."

Arias Denied Guilt Despite Sex Photos, DNA

A defiant Jodi Arias insisted she was innocent of killing her ex-boyfriend Travis Alexander even after a detective told her that he had nude photos of them together on the day he died.

"Are you sure it's me? Because I was not there," Arias is heard saying in the police interrogation tape played for the Arizona jury today.

When Detective Esteban Flores tells Arias she is seen in pigtails in the photos, she asks with a tone of incredulity, "Pigtails?"

As Flores laid out more incriminating evidence, including that investigators found DNA of their blood mixed together, her hair stuck with blood and her palm print in blood, Arias was insistent.

"I would not hurt Travis. I would not hurt Travis. I would not do that to him," she told Flores.

At another point Arias said, "If I hurt Travis I would beg for the death penalty."

"Jodi, this is over. … you have to tell me the truth," Flores says. The detective suggests a motive for the killing to be jealousy, and cites the opinion of Alexander's friends.

"They don't just say you were jealous. You were absolutely obsessed… a fatal attraction," Flores in heard on the tape.

Arias, now 32, has since admitted to killing Alexanderfollowing their tryst in 2008, but has claimed it was self-defense. She is accused of stabbing Alexander 27 times in the chest, back, and head, slashing his throat from ear to ear, and shooting him the head with a .25 caliber handgun.

Arias is charged with murdering her ex-boyfriend in a "heinous and depraved" way and could face the death penalty if convicted.

The interrogation tape was played after the jury was shown sexually graphic photos that police recovered from Alexander's digital camera. Among the pictures were shots of Arias and Alexander posing naked on Alexander's bed, as well as pictures of Alexander in the shower.

Those photos were the last pictures of Alexander while he was alive.

Arias looked away from the screen in the courtroom where the sexual photos were shown, as her mother watched from the gallery. Alexander's sisters, also seated in the gallery, looked away from the photos of their brother.

Computer analysts for the city of Mesa, Ariz., where Alexander lived, went over the photos in detail during the sixth day of testimony in the trial. The photos were time stamped June 4, 2008, beginning around 1:45 p.m.

Prosecutors have said that Arias drove from her California home to Alexander's house, arriving early in the morning on June 4. The pair had sex in the afternoon, took photos of one another, and then Arias killed Alexander, age 30, around 5:30 p.m., they said.

The photos on the bed occurred around 1:45 p.m., according to the data on the camera. The shower photos and the pictures of a bloody body part occurred around 5:30 p.m.

In earlier testimony today, the jury watched video taped interrogations of Arias as she repeatedly denied to police stealing and using the handgun that killed Alexander.

Arias told police that she had never seen a .25 caliber handgun and had no idea her grandparents owned one until they reported it stolen a week before Alexander's killing, according to the police interrogation tapes played in court today.

Police from Yreka, Calif., where Arias lived with her grandparents, described the scene of the home when Arias's grandparents reported a break-in. The door was pushed in, breaking the door jamb, and many drawers were opened in Arias' bedroom and her grandparents' room.

The only things reported taken were the handgun, a DVD player, and $30, while other valuable items, including a large pile of quarters and three other guns, were left untouched. Arias told police that her laptop computer was not taken because she had hidden it in a laundry basket covered with clothes.

Officer Kevin Friedman of the Yreka police department told the court today that burglary struck him as odd.

"I believed it was unusual that small items worth money or money, for instance, that the change was not taken," said Officer Kevin Friedman, of the Yreka police department, who investigated the alleged robbery. "I also thought it was strange that only one of the firearms was stolen from the cabinet."

In the police videos, Arias is seen calmly denying stealing the gun from her grandparents' home and using it when she killed Alexander in June 2008, a week after the burglary.

Poisoned Lottery Winner's Kin Were Suspicious

Urooj Khan had just brought home his $425,000 lottery check when he unexpectedly died the following day. Now, certain members of Khan's family are speaking publicly about the mystery -- and his nephew told ABC News they knew something was not right.

"He was a healthy guy, you know?" said the nephew, Minhaj Khan. "He worked so hard. He was always going about his business and, the thing is: After he won the lottery and the next day later he passes away -- it's awkward. It raises some eyebrows."

The medical examiner initially ruled Urooj Khan, 46, an immigrant from India who owned dry-cleaning businesses in Chicago, died July 20, 2012, of natural causes. But after a family member demanded more tests, authorities in November found a lethal amount of cyanide in his blood, turning the case into a homicide investigation.

"When we found out there was cyanide in his blood after the extensive toxicology reports, we had to believe that ... somebody had to kill him," Minhaj Khan said. "It had to happen, because where can you get cyanide?"

Authorities could be one step closer to learning what happened to Urooj Khan. A judge Friday approved an order to exhume his body at Rosehill Cemetery in Chicago as early as Thursday to perform further tests.

Moments after the court hearing, Urooj Khan's sister, Meraj Khan, remembered her brother as the kind of person who would've shared his jackpot with anyone. Speaking at the Cook County Courthouse, she hoped the exhumation would help the investigation.

"It's very hard because I wanted my brother to rest in peace, but then we have to have justice served," she said, according to ABC News station WLS in Chicago. "So if that's what it takes for him to bring justice and peace, then that's what needs to be done."

Khan reportedly did not have a will. With the investigation moving forward, his family is waging a legal fight against his widow, Shabana Ansari, 32, over more than $1 million, including Urooj Khan's lottery winnings, as well as his business and real estate holdings.

Khan's brother filed a petition Wednesday to a judge asking Citibank to release information about Khan's assets to "ultimately ensure" that [Khan's] minor daughter from a prior marriage "receives her proper share."

Ansari may have tried to cash the jackpot check after Khan's death, according to court documents, which also showed Urooj Khan's family is questioning if the couple was ever even legally married.

Ansari, Urooj Khan's second wife, who still works at the couple's dry cleaning business, has insisted they were married legally.

She has told reporters the night before her husband died, she cooked a traditional Indian meal for him and their family, including Khan's daughter and Ansari's father. Not feeling well, Khan retired early, Ansari told the Chicago Sun-Times, falling asleep in a chair, waking up in agony, then collapsing in the middle of the night. She said she called 911.

"It has been an incredibly hard time," she told ABC News earlier this week. "We went from being the happiest the day we got the check. It was the best sleep I've had. And then the next day, everything was gone.

"I am cooperating with the investigation," Ansari told ABC News. "I want the truth to come out."

Ansari has not been named a suspect, but her attorney, Steven Kozicki, said investigators did question her for more than four hours.

Obama Promises Faster Transition in Afghanistan

President Obama and Afghan President Hamid Karzai said today that most U.S. combat operations in Afghanistan would end this spring, signaling a quickening troop drawdown that will bring the decade-long war to a close at the end of 2014.

"Our troops will continue to fight alongside Afghans when needed, but let me say it as plainly as I can: Starting this spring, our troops will have a different mission -- training, advising, assisting Afghan forces," Obama announced at an East Room news conference in Washington.

"It will be a historic moment and another step toward full Afghan sovereignty, something I know that President Karzai cares deeply about, as do the Afghan people," he said.

Administration officials said Afghan forces were "exceeding initial expectations" in their capabilities. Afghan security forces are expected to lead 90 percent of security operations across the country in February.

"By the end of next year -- 2014 -- the transition will be complete," Obama said. "Afghans will have full responsibility for their security, and this war will come to a responsible end."

The rosy assessments belied the serious political, economic and security challenges that remain.

Left unanswered by Obama and Karzai: How many U.S. troops might stay after 2014; what their mission would be and whether they could be effective; and whether the forces would have immunity from prosecution in Afghan courts.

Obama said he was still reviewing recommendations from the Pentagon and will make an announcement in the coming weeks after penning an anticipated bilateral security agreement with Afghanistan. Karzai said the exact number would be up to the United States to decide.

Both leaders confirmed in a statement that the United States "does not seek permanent bases in Afghanistan."

They also agreed today to turn over battlefield combatants held by the U.S. military in Afghanistan to Afghan government control, which has been long-sought by Karzai.

Roughly 66,000 U.S. troops are serving in Afghanistan. The military has proposed keeping several thousand troops in the country after 2014 as advisers, trainers and logistical support for Afghan forces; the White House has said it remains open to pulling out all troops entirely.

Obama's visit with Karzai was the first face-to-face encounter since the November election and since last year's dramatic increase in so-called green-on-blue attacks, when U.S. and NATO soldiers have been killed by the Afghans they are training or working alongside.

There were 45 insider attacks in 2012 that resulted in 62 deaths among coalition forces, including 35 Americans. There has been one attack already in the first 11 days of 2013.

The White House summit included a private Oval Office meeting between Obama, Karzai and Vice President Joe Biden. The trio also attended a private lunch in the Old Family Dining Room.

Karzai Thursday attended meetings with Defense Secretary Leon Panetta and top military brass at the Pentagon, where he was afforded all the pomp and circumstance accorded a head of state: a 21-gun salute, and marching bands and honor guards from the Army, Navy, Air Force, Marines and Coast Guard.

Karzai's relationship with the United States has at times been a rocky one as he has sometimes made critical statements about the allied troop presence in his country. U.S. officials believe he has made those comments out of political expediency to improve his standing with Afghans and show his independence.

Hero Teacher Talks Shooter into Dropping Gun

A California high school teacher is being hailed a hero for talking a 16-year-old shooter into putting down his gun and turning himself in after opening fire on a classroom and wounding another student, police said.

The student victim was taken to a nearby hospital and remains in critical but stable condition, Kern County Sheriff Donny Youngblood told reporters on Thursday.

The teacher, whose name has not yet been officially released by authorities, helped evacuate nearly two dozen students out a door at Taft Union High School in Taft, Calif., while calmly engaging the young gunman, who is a student at Taft Union, in conversation.

The teacher and a campus supervisor, who responded to the gunfire and arrived at the classroom, helped convince the teenager to stop shooting.

"They talked him into putting the shotgun down," Youngblood said.

The shooting began around 9 a.m. in the school's science building and sheriff's deputies were on the scene within one minute of the call. An armed security guard who is typically at the school was not on campus because he had been snowed in, the sheriff said.

Two other students received minor injuries: One reported hearing loss and the other fell over a table. The teacher was shot with a pellet, but refused medical treatment, according to police.

The school's 900 students were evacuated from the building and many of them were met by parents within minutes of the first 911 calls.

Today's shooting comes less than month after 20-year-old Adam Lanza opened fire on an elementary school in Newtown, Conn. killing 20 children and six adults.

Arias Caught Lying to Cops in Recorded Phone Calls

Jodi Arias blatantly lied to police who asked her about Travis Alexander's death, telling them in recorded phone calls that she kept trying to call and message Alexander the week of his death but never heard back from him.

The phone calls were played as evidence during the fourth day of Arias' trial, in which she is charged with murder and could face the death penalty if convicted of killing Alexander in a "depraved and heinous" way. Arias has admitted to killing her former boyfriend, but claims it was self-defense.

During the phone conversations played in court, Arias can be heard telling Mesa, Ariz., detective Esteban Flores that she last talked to Alexander on Tuesday night, June 3, 2008, around 10 p.m. She had been in Los Angeles, about to leave to go to Utah to visit a new love interest, she said.

After June 3, he stopped calling her back, she said.

"On Tuesday night (I talked to him), it was brief though, 10 o'clock maybe. I'd say 10 p.m. or 9 - 9:30. I was calling people because I was bored on the road. He was nice and cordial, but kind of acting like he had hurt feelings," she said.

"I may have called him Wednesday, from the road, and I sent him a couple of text messages, and a couple of pictures," she said, though Alexander didn't pick up and his voice mailbox was full. "That's unusual. He deletes all of his messages. I didn't want to be obsessive about it because we're not together anymore and I didn't like to call too much."

According to court records, Arias, 32, actually went to Alexander's home on in Mesa on Wednesday morning. There, the pair had sex and took graphic photos of one another with Alexander's camera.

Then, Arias is believed to have killed Alexander, 30, in his shower by stabbing him, slashing his throat from ear to ear, and shooting him in the head.

In the phone conversations, Arias told Flores that she considered calling Alexander's friends when he stopped returning her calls on Wednesday, but didn't want to act like "his mother."

Alexander's friends found his body five days later with stab wounds and a bullet wound, lying in blood in his home.

Flores asked Arias if she ever considered buying a gun, she said she was too scared of handguns.

"I've looked into handguns. I have a list of things I'm scared of that I'm trying to overcome," she said. "I got that from Travis, you know, to push yourself out of your comfort zone, and do things you're afraid of. But handguns are expensive and not really in my price range right now."

Arias is accused of stealing her grandmother's handgun and using it to shoot Alexander in the head during the attack.
The detective interviewed Arias by phone multiple times in June after Alexander's body was discovered by his friends on June 9.

Arias was indicted on July 9, 2008, and changed her story again before her arraignment, telling a TV news station that she was at Alexander's house when he was killed and witnessed two intruders kill him.

After she was arraigned, Arias told police she killed Alexander, but did it in self-defense. Arias's attorneys have said that Alexander was controlling and abusive toward Arias, and described him as a "sexual deviant."

In earlier testimony in court today, Arias's new love interest, Ryan Burns, testified that Arias showed up to his house on the morning of Thursday, Dec. 5, just 24 hours after she killed Alexander.

There, the pair cuddled, kissed, and watched movies, according to Burns.

Burns, who met Arias at a business conference in spring, 2008, said he exchanged frequent long phone calls and online conversations with Arias before inviting her to come visit him in West Jordan, Utah, in June. Arias lived in California at the time.

She arrived at Burns's home 24 hours after she was expected there, telling him that she got lost, drove the wrong way on a freeway for a few hours, fell asleep for awhile, and then got lost again, Burns testified today.

She never told him that she had confronted Alexander with a knife or gun and ended up killing him just hours before their date.

When she arrived, the pair quickly got physical, he testified.

"We went back to my house. We talked for awhile, and agreed that we were going to watch a movie. At some point we were talking and we kissed. Every time we started kissing it got a little more escalated. Our clothes never came off, but at some point she was kissing my neck, I was kissing hers, but our clothes never came off," he said.

Burns said that both he and Arias stopped kissing at the time, though they again became physically involved later in the evening when Arias climbed on top of Burns and began kissing him. Burns said that they stopped kissing because he did not want her to "regret the visit" because of her Mormon beliefs about sex.

He also told prosecutors upon questioning that Arias was physically strong.

"She's very fit," he said, describing their encounter when she climbed on top of him. "She's very strong. She has close to a six pack (of abs)."

Prosecutors likely asked about the strength of Arias because in testimony Tuesday Maricopa County medical examiner Kevin Horn said Alexander was stabbed so forcefully that the blade chipped his skull and his neck was cut all the way back to the spinal cord.

Burns, who is also a Mormon, said he noticed two bandages on Arias's hand when she arrived at his house, which she told him she got when a glass broke at her place of employment, Margaritaville.

During her visit, the pair also went to a business meeting and went out with Burns' friends where Burns described Arias as acting "shy" and a "little awkward."

"She was fine, she was laughing about simple little things like any other person. I never once felt like anything was wrong during the day. With a crowd she was a little awkward in social areas, but one on one she was very talkative and excitable," he said.

Menu Calorie Counts: How Accurate Are They?

They are supposed to help America's obesity problem: calorie counts boldly displayed on restaurant menus across the country and important information, considering Americans now eat one-third of their meals outside the home.

Two states and nine counties require them today, and by the middle of next year, a federal law is expected to force chain restaurants, convenience stores and vending machines nationwide to post calorie counts.

But how accurate are those numbers that so affect your waistline?

A 2011 study by Tufts University sampling food from 42 restaurants says it depends.

Fast food restaurants were the most accurate because of the uniform recipes and portions, but there were wide variations found in sit-down restaurants.

"We found that 20 percent of the foods we tested had 100 calories or more over what was stated on the menu," Lorien Urban, a postdoctoral associate in the energy metabolism lab at Tufts University and first author of the study, told ABC News. "We would consider that to be a considerable amount."

Urban explained that consuming an extra 100 calories per day can lead to an extra 10 pounds in one year.

Most concerning was that a majority of the errors Urban and her colleagues found were made on the diet side of the menu.

"These were the foods that people who are trying to manage their weight would gravitate towards and they may be getting more calories than they expect," she said.

ABC News sent producers in three cities that already require posting menu calories to major chains to do a sampling under the direction of a nationally known lab and found that more than half of the low-cal meals tested had more calories than listed on the menu.

In total 24 food samples from four sit-down restaurants and one McDonald's were collected and the results were surprising.

McDonald's did the best. Its Big Mac Meal (posted: 930) and its Premium Chicken Sandwich (posted: 400) tested 30 calories below the menu posting.

But the sit-down restaurants had results sometimes wildly different than advertised.

In all, only one calorie count was accurate -- a Skinnylicious chicken salad sandwich from the Cheesecake Factory.

Eleven meals had more calories than on the menu and 10 had fewer calories. Some were over by only 40 calories; another was over by as much as 420 calories, again at the Cheesecake Factory: This time an order of the fish and chips dinner.

Urban said that fast food restaurants tended to be more accurate than sit-down because of the formulaic preparation that fast food restaurants use.

"Things are arriving already packaged into the restaurants and it's just a matter of warming it up and serving it to the consumer," she said. "A sit-down restaurant, things are being prepared on [the] spot [and] by chance some extra butter gets into the pan."

That can change the calorie amount.

All the restaurants and their trade association say that most calorie counts are as accurate as possible and tested extensively to make sure.

They conceded that there are variations, mostly due to portion size and individual restaurant preparation, and that the menus warn actual calories may vary.

What can you do? Take control of what is put on top of the entree by asking for everything fattening -- such as cheeses, sauces or dressings -- on the side.

Colo. Suspect Bought Ticket 12 Days Before Shooting

Accused Aurora movie theater gunman James Holmes bought his movie ticket 12 days before the shooting, it was revealed in court today during the emotional first day of a preliminary hearing.

Aurora Police Department homicide detective Matthew Ingui testified that there is no video surveillance of the actual shooting, but there are several photos of Holmes checking into the theater kiosk with his cellphone. He scanned his phone three times.

Surveillance footage shown in court for the first time also showed Holmes lingering by the concession stand for about three minutes before entering theater nine dressed in dark pants, a light colored shirt and a skull cap. He would later be caught wearing a bullet proof vest and a gas mask.

Another video showed the lobby the moment theater staff heard shots ring out. Some of them ducked behind counters as people started streaming out of the front door.

Ingui also testified about the positions of the bodies in the theater, strewn across seats and aisles.

Holmes is accused of killing 12 people and wounding dozens more in the movie theater massacre.

Earlier in the day, two veteran police officers broke down on the stand, with one officer choking up when he described finding the body of a 6-year-old girl inside the theater.

Sgt. Gerald Jonsgaard needed a moment to compose himself as he described finding the little girl, Veronica Moser Sullivan, in the blood splattered theater.

An officer felt for a pulse and thought Veronica was still alive, Jonsgaard said, but the officer then realized he was feeling his own pulse.

The officers wiped away tears as they described the horror they found inside of theater nine.

Officer Justin Grizzle recounted seeing bodies lying motionless on the floor, surrounded by so much blood he nearly slipped and fell.

Grizzle, a former paramedic, says ambulances had not yet made it to the theater, so he began loading victims into his patrol car and driving to the hospital.

"I knew I needed to get them to the hospital now, " Grizzle said, tearing up. "I didn't want anyone else to die."

Grizzle drove six victims in four trips, saying that by the end there was so much blood in his patrol car he could hear it "sloshing around."

An officer who took the stand earlier today described Holmes as "relaxed" and "detached" when police confronted him just moments after the shooting stopped.

The first two officers to testify today described responding to the theater and spotting Holmes standing by his car at the rear of the theater on July 20, 2012. He allegedly opened fire in the crowded theater during the midnight showing of "The Dark Knight Rises."

Officer Jason Oviatt said he first thought Holmes was a cop because he was wearing a gas mask and helmet, but as he got closer realized he was not an officer and held Holmes at gunpoint.

Throughout the search and arrest, Holmes was extremely compliant, the officer said.

"He was very, very relaxed," Oviatt said. "These were not normal reactions to anything. He seemed very detached from it all."

Oviatt said Holmes had extremely dilated pupils and smelled badly when he was arrested.

Officer Aaron Blue testified that Holmes volunteered that he had four guns and that there were "improvised explosive devices" in his apartment and that they would go off if the police triggered them.

Holmes was dressed for the court hearing in a red jumpsuit and has brown hair and a full beard. He did not show any reaction when the officers pointed him out in the courtroom.

This is the most important court hearing in the case so far, essentially a mini-trial as prosecutors present witness testimony and evidence -- some never before heard -- to outline their case against the former neuroscience student.

The hearing at the Arapahoe County District Court could last all week. At the end, Judge William Sylvester will decide whether the case will go to trial.
